Terms of Service

BitterDisk ("BitterDisk", "we", "us") is a short-lived file-transfer service operated by Bitter. By uploading a file, opening a code, or otherwise using BitterDisk, you agree to these Terms. If you do not agree, do not use the service.

What BitterDisk is

BitterDisk moves a file between devices using a short code. It is not storage, backup, or a private vault. Uploaded files and their codes expire and are deleted automatically, normally within 24 hours (up to 72 hours with a paid Transfer Pass). Short codes are for convenience, not secrecy — anyone who has a code can download its files until they expire.

Your content and conduct

You are solely responsible for everything you upload, share, or download. You represent and warrant that you own or have all rights necessary to transfer the content and that doing so does not violate any law or any third party's rights. You agree not to upload, share, or request anything prohibited by our Acceptable Use Policy.

Our rights

We may, at our sole discretion and without notice or liability: remove or refuse to transfer any content; suspend or block any user, IP address, or code; preserve and disclose content or logs to law enforcement or other authorities where we believe it is required or appropriate; and change, limit, or discontinue the service. We are under no obligation to monitor content, but we may. We have no obligation to store, back up, retain, or return any content.

Payment

A Transfer Pass is a one-time purchase that raises size and duration limits for a single transfer window. Payments are processed by Stripe through BitterCheckout; we do not store your card details. Except where required by law, payments are non-refundable, though we may issue refunds at our discretion.

No warranty

The service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, availability, or that files will be delivered, retained, or transmitted without error or loss.

Limitation of liability

To the maximum extent permitted by law, Bitter and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the service. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD $20.

Indemnification

You agree to indemnify and hold harmless Bitter and its operators from any claims, damages, or costs (including reasonable legal fees) arising out of the content you transfer or your use of the service in violation of these Terms or the law.

Changes and governing law

We may update these Terms; continued use after a change means you accept it. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. Questions or notices: abuse@bitterdisk.com.
